§1 Scope of Application
These Terms and Conditions apply to all applications and payments made as part of online auditions via concerts-audition.com, operated by Malinovsky Events GmbH & Co. KG.
By submitting an application, the applicant expressly agrees to these T&Cs.
§2 Subject Matter of Service
(1) Via concerts-audition.com, Malinovsky Events GmbH & Co. KG offers an artistic selection platform for soloists (violin, cello, piano, voice).
(2) The subject matter of the service is exclusively the conducting of the application and selection process for concert productions.
(3) No claim to selection, engagement, or contract conclusion exists.
§3 Application & Multiple Applications
(1) Each application relates exclusively to one specific concert date.
(2) Applicants may apply separately for multiple concert dates.
(3) Each individual application constitutes an independent selection process and is evaluated independently of other applications.
§4 Participation Fee / Registration Fee
(1) A separate participation fee must be paid for each individual concert application.
(2) The respective amount of the participation fee is transparently displayed during the application process.
(3) The participation fee is due immediately upon submission of the application.
§5 Non-Refundability of Participation Fee
(1) The participation fee is non-refundable.
This applies expressly also in the following cases:
- Non-selection in the application process
- Selection for only one or several, but not all applied concert dates
- Withdrawal by the applicant
- Multiple applications for different concert dates
- Changes to the program, cast, or artistic concept
(2) Offsetting, partial refunds, or credits for multiple applications are excluded.
In particular, no refund claim exists if an applicant applies for multiple concert dates and is selected for only one or individual dates.
(3) The participation fee remains non-refundable even if a concert date is
– cancelled,
– postponed,
– rescheduled in time or location
or
– not performed,
regardless of the reason for the change.
(4) This applies in particular to cases of force majeure, official orders, illness of performers, organizational changes, or other circumstances beyond the organizer's control.
(5) The participation fee covers the organizational, technical, and artistic expenses of the respective application and selection process and is not tied to the realization or performance of a concert.
§6 Selection Process & Personal Feedback
(1) Selection of applicants is made exclusively by the artistic director based on submitted application materials and video recordings.
(2) No claim to selection or engagement exists. The decision is artistic in nature and not contestable.
(3) Non-selected applicants receive personal feedback by email containing individual assessments, artistic recommendations, and possibly concrete suggestions for development.
(4) The type, scope, and detail of feedback is at the artistic discretion of the artistic director and depends on the respective application profile.
(5) No claim exists to a specific feedback format, length, or response within a fixed timeframe.
§7 Contract Conclusion upon Selection
(1) In case of positive selection, the applicant receives a separate engagement or fee offer.
(2) Only upon signing this contract does an engagement come into effect.
(3) Travel, accommodation, and fee details are not part of the application process and are regulated individually.
§8 Rights to Submitted Materials
(1) The applicant warrants that they hold all necessary rights to the submitted video, audio, and image materials.
(2) The materials are used exclusively for internal artistic evaluation.
(3) No public or commercial use takes place without separate written agreement.
§9 Data Protection (GDPR)
(1) Processing of personal data by Malinovsky Events GmbH & Co. KG occurs exclusively for conducting the online audition via concerts-audition.com.
(2) No transfer to unauthorized third parties takes place.
(3) Application and video data are deleted in compliance with data protection after completion of the selection process, unless statutory retention periods apply.
(4) The website's privacy policy applies additionally.
§10 Liability
(1) Malinovsky Events GmbH & Co. KG is not liable for technical disruptions, particularly in data transmission, uploads, or payment processing.
(2) Liability for lost engagements or consequential damages is excluded.
§11 Final Provisions
(1) German law applies.
(2) The place of jurisdiction is – to the extent legally permissible – the registered office of Malinovsky Events GmbH & Co. KG.
(3) Should any provision of these T&Cs be invalid, the validity of the remaining provisions remains unaffected.
